The Nigerian Chambers of Commerce Dispute Resolution Centre (NCC-DRC), an arm of the Abuja Chamber of Commerce and Industry (ACCI), has launched a campaign pushing small businesses to ditch traditional litigation for debt collection. Registrar-General Mrs. Hauwa Usman revealed that thousands of small commercial claims—ranging from delayed supply chain invoices to commercial property rental defaults—are written off by local entrepreneurs annually due to the notorious 15-year average delay in Nigerian courts. The chamber is positioning its Mediation Rules 2019 as a swift, budget-friendly legal alternative specifically designed to ensure that justice is not reserved only for blue-chip corporations with deep pockets.

The out-of-court framework operates under three distinct operational guidelines:

  • Frictionless Onboarding (Rule 2.3): A business can initiate a claim without complex legal filings or upfront lawyer retention. The claimant simply sends an email to the centre detailing the dispute value. The opposing party is given exactly 21 days to respond; failure to do so lets the claimant immediately pursue other legal avenues.

  • The Confidentiality Guardrail (Rules 7 & 8): To encourage honest settlements, all financial disclosures, asset records, and compromises made during mediation sessions are legally sealed. They cannot be introduced as evidence if the case eventually leaks into a formal courtroom or arbitration panel.

  • Equitable Cost Sharing (Rule 14.2 & 13): Administrative costs are split equally between both parties, and any leftover deposits are fully refunded upon case closure. Once an agreement is reached and signed by both parties and the mediator, it graduates into a legally binding contract that can be directly enforced through the courts if breached.
